Article 1 - Purpose
These terms and conditions apply to direct bookings for stays at Villa Pier'Art, a furnished holiday rental located in Touques.
They govern contract formation, financial terms, the main stay rules and cancellation terms. They apply subject to any more specific provisions included in the personalised contract sent to the guest at the time of booking.
Article 2 - Booking
A booking may be initiated through the website or, exceptionally, by direct exchange, subject to written confirmation. Contractual information is presented in French, which remains the authoritative version.
The booking becomes firm once the booking flow has been validated, the contract has been accepted, and the deposit or total price has actually been collected when immediately due.
Article 3 - Prices
The prices shown on the website are expressed in euros. They correspond to the rental amount for the selected dates and parameters, based on the information available at the time of booking.
The mandatory end-of-stay cleaning fee is included in the total price when indicated in the summary. Tourist tax, where applicable, is payable in addition at the legal rate in force.
The publisher reserves the right to change prices at any time, it being specified that the stay is invoiced on the basis of the rate in force when the booking is confirmed.
Article 4 - Payment
Payment is made online by bank card through a secure payment provider. A 50% deposit of the total rental price is requested at booking.
The balance is due:
- 30 days before arrival for stays outside high season;
- 60 days before arrival for any stay including at least one night between 1 July and 31 August or between 23 December and 2 January.
For any booking made less than 30 days before arrival, or less than 60 days before arrival in high season, the full price is immediately due at booking.
If the balance is not fully paid by its due date, the owner may, 24 hours after a written reminder has remained without effect, terminate the booking automatically at the guest's fault.
The booking process on the website relies in particular on displaying the personalised contract, reading it, expressly accepting it by checkbox and validating payment.
Article 5 - Cancellation terms
The applicable cancellation terms are as follows, subject to any more specific provisions that may be recalled in the personalised contract:
- outside high season, the guest may cancel free of charge up to 30 days before arrival;
- in high season, the guest may cancel free of charge up to 60 days before arrival;
- after these deadlines, sums already paid remain acquired by the owner.
Article 6 - No withdrawal right
Under the rules applicable to accommodation services supplied on a specific date or period, the guest does not benefit from a fourteen-day withdrawal right.
Article 7 - Security deposit
A EUR 1,000 security deposit may be requested in the form of a card pre-authorisation taken 24 hours before arrival, unless another method has been agreed in writing. This pre-authorisation is not captured in the absence of outstanding sums, damage, loss, extra cleaning or necessary repairs.
Article 8 - Occupancy, capacity and stay
The property is rented for a maximum capacity of 10 persons. The guest undertakes to use the premises peacefully and to respect neighbours, equipment, safety instructions, the estate rules and the provisions of the personalised rental contract.
Article 9 - Consumer mediation
After a prior written complaint that has not been resolved satisfactorily, any consumer may refer the matter free of charge to the consumer mediator appointed by the owner:
Article 10 - Applicable law and jurisdiction
These terms are governed by French law. In the event of a dispute, the parties will first seek an amicable solution. Failing agreement, the consumer may refer the matter to the territorially competent court in accordance with the applicable legal rules.
The French version prevails.
